These terms are an agreement between you and [Registered company name] ("GigMoney", "we", "us"). They apply when you visit this website, use the GigMoney dashboard or use the GigMoney mobile app (together, the "Services"). By creating an account, accepting an invitation or using the Services, you agree to these terms and to our Privacy policy. If you use the Services for an organisation, you confirm you are authorised to accept these terms for it.
A company or vendor may also sign an order, work order or commercial agreement with us. If that agreement conflicts with these terms, the signed agreement wins for that subject.
1. Who is who
- Company: a brand, agency or business that creates campaigns on the platform.
- Vendor: a field agency that receives a work order from a company and runs it with its own teams.
- Reviewer: a person a company appoints to approve or reject task proof.
- Team lead: a vendor’s supervisor for one or more teams of gig workers.
- Gig worker: an individual who accepts tasks and submits proof through the app.
- Task: a unit of work in a campaign, such as an installation, survey or audit, completed with photo and location proof.
2. Eligibility and accounts
- You must be at least 18 years old and able to enter a binding contract under Indian law.
- Give accurate information and keep it up to date, including your mobile number, email and, for organisations, PAN, GSTIN and bank details.
- Keep your password and one-time codes secret. You are responsible for everything done through your account. Tell us at once if you suspect misuse.
- One person, one account. Do not share, sell or transfer accounts.
- Organisation owners and admins control who joins their organisation and which roles they hold.
3. What GigMoney provides
GigMoney is a technology platform that lets companies run field campaigns, assign them to vendors, split work across teams and workers, collect geotagged photo proof, review it and track earnings. Where a company chooses a managed plan, we may also help source vendors and workers.
We are not a party to the work arrangement between a vendor and its workers unless we say so in a signed agreement. We do not guarantee that any campaign, task or volume of work will be available.
4. Terms for companies
- You are responsible for the content, legality and permissions of your campaigns, including permission from property and vehicle owners where branding is installed.
- Set clear task instructions, locations, rates and reject reasons. Review proof fairly and in good time, and give a reason when you reject a task.
- Pay the fees in your plan or agreement on time. Unless agreed otherwise, invoices are due within the period stated on them and fees exclude GST.
- You may revoke a work order only while no work has started under it.
- Use worker data only to manage your campaigns, and never contact workers to take work off the platform to avoid fees.
5. Terms for vendors and team leads
- Run accepted work orders within the agreed area, quota, rate and dates.
- You are responsible for your workers and team leads: their onboarding, conduct, safety, statutory obligations and payment, unless a signed agreement says otherwise.
- Do not assign more work, or pay a higher rate, than the work order allows.
- Keep your organisation’s identity and bank details accurate. Settlements are made only to the verified account on file.
6. Terms for gig workers
- You choose which tasks to accept. You are an independent contractor, not an employee of GigMoney, the company or, unless you have agreed otherwise with them, the vendor.
- Do the task yourself, at the assigned place, and take proof photos in the app at that place. Only genuine, live photos count.
- Payment is per approved task at the rate shown when you accepted it, plus any offer that applies. A rejected task is not paid unless it is resubmitted and approved where the campaign allows it.
- You are responsible for your own taxes. Payments may be subject to tax deduction where the law requires it.
- Work safely and follow local laws. Do not enter private property or install branding without permission.
- GigMoney does not promise any minimum income or volume of work.
7. Proof, review and disputes
Each submission is reviewed by a person appointed by the company. A reviewer may reject proof that is unclear, outside the assigned area, incomplete or not genuine, and must give a reason. Where the campaign allows it, a worker may fix and resubmit a rejected task. If you believe a decision is wrong, raise it with your vendor or contact us and we will look into it.
8. What you must not do
- Submit fake, edited, reused or borrowed photos, spoof your location or claim work you did not do.
- Create duplicate or false accounts, or use someone else’s identity.
- Ask any customer or shopkeeper for passwords, OTPs, card numbers or other financial credentials.
- Harass, threaten or discriminate against anyone, or behave unsafely in the field.
- Collect or misuse other users’ personal data, or try to see records outside your role.
- Reverse engineer, scrape, overload or break the security of the Services, or upload malware.
- Use the Services for anything illegal, misleading or that infringes someone else’s rights.
We may withhold payment for work linked to fraud, and suspend or close accounts that break these rules.
9. Financial product distribution
Online distribution of financial products is launching soon and will have its own additional terms. Agents will need to complete KYC, refer customers only to regulated partners, let customers apply on the partner’s own journey, give accurate product information and never promise approval. GigMoney does not lend, issue cards or sell insurance itself, and the partner alone decides whether to approve a customer.
10. Content and intellectual property
The Services, the GigMoney name and logo, software and design belong to us or our licensors. We give you a limited, non-exclusive, non-transferable right to use them for their intended purpose while your account is active.
Companies own their campaign content and the proof collected for their campaigns. Workers grant the company running the campaign, and us, the right to store, show and use their submitted proof for that campaign, reporting, audits and dispute resolution. We may use anonymised, aggregated data to improve the Services.
11. Confidentiality
Campaign details, rates, offers and other users’ information you see on the platform are confidential. Use them only for the work you were given and do not share them outside the platform.
12. Availability and changes to the Services
We work to keep the Services available and secure, but they are provided "as is" and "as available". We may change, suspend or retire features, and we may need downtime for maintenance. Where a change materially reduces what a paying customer receives, we will give reasonable notice.
13. Disclaimers and limits of liability
- To the extent the law allows, we disclaim all implied warranties, including fitness for a particular purpose.
- We are not liable for indirect, incidental or consequential losses, or for loss of profit, revenue, data or goodwill.
- We are not responsible for the acts of companies, vendors, team leads or workers, for third-party services, or for events beyond our reasonable control.
- Our total liability for any claim is limited to the fees you paid us for the Services in the three months before the claim, or ₹10,000 if you paid nothing.
Nothing in these terms limits liability that cannot be limited under Indian law.
14. Indemnity
You agree to compensate us for losses and reasonable costs arising from your breach of these terms, your misuse of the Services, your campaign content or your violation of any law or third-party right.
15. Suspension and termination
You can stop using the Services at any time. Organisations can close their account by contacting us, subject to settling open work orders and fees. We may suspend or close an account at once if it breaks these terms, poses a risk to other users or the law requires it, and otherwise on 15 days’ notice. Approved work completed before termination is settled as normal unless it is linked to fraud. Sections that by their nature should survive, such as payment, confidentiality, liability and disputes, survive termination.
16. Changes to these terms
We may update these terms. We will post the new version here with a new date and, for material changes, tell you by email or in the app at least 15 days before they take effect. If you keep using the Services after that, you accept the updated terms.
17. Governing law and disputes
These terms are governed by the laws of India. Please contact us first so we can try to resolve any dispute informally within 30 days. If that fails, the dispute will be settled by arbitration by a sole arbitrator under the Arbitration and Conciliation Act, 1996, seated in [City], in English. Subject to that, the courts at [City] have exclusive jurisdiction.
18. General
- If any part of these terms is unenforceable, the rest stays in force.
- Not enforcing a right is not a waiver of it.
- You may not transfer your rights under these terms without our consent. We may transfer ours as part of a merger, acquisition or restructuring.
- We send notices by email or in the app. You can send notices to the contact details below.
19. Contact and grievances
Under the Information Technology Act, 2000 and its rules, you can raise any complaint about the Services with our Grievance Officer:
- Name: [Grievance Officer name]
- Email: [grievance email]
- Address: [Registered company name], [Registered office address]
